Climate protection through the courts? The case of Lluiya against RWE (in German)

While ambitious climate protection in politics has noticeably waned, climate lawsuits are currently gaining in importance, such as that of the Peruvian smallholder Lliuya, who wants to involve the RWE Group in climate protection measures and obtain financial compensation for possible environmental damage.

Can a farmer from Peru hold the energy company RWE liable for the climate crisis? Saúl Luciano Lliuya's lawsuit is considered a historic precedent - and the judgement is imminent. Together with Mascha Klein, legal officer at the NGO Germanwatch e. V., we will be discussing the significance of the case for climate protection in court.

While the political momentum in favour of ambitious climate protection has slowed noticeably since the Paris Climate Agreement of 2015, climate lawsuits are becoming increasingly important. The civil action brought by the Peruvian Andean farmer Saúl Luciano Lliuya against the energy company RWE before the Hamm Higher Regional Court is considered one of the most important precedents on the question of whether and how global corporations can be held legally responsible for the consequences of the climate crisis. Together with Professor Dr Michael Riegner and Mascha Klein, an expert on the case, we will discuss the ruling expected on 28 May - and what it means for climate protection through the courts.
